By purchasing any service, you are agreeing to the Terms & Conditions as expressed below:

Quotes
All quotes will be given only after a pre-client questionnaire is filled out. All quotes provided be honored for 10 business days from the date of creation.

Project Selection
Premium Website/Blog Designs
If the project is selected, an initial non-refundable 50% deposit is required to hold the client’s place in the design queue. The remaining 50% balance is due before installation of the website. All website related projects under $500 must be paid in FULL before any design work will begin. All websites are designed on a demo site and will be transferred to your server once the final payment has been made.
Logo Designs
If the project is selected, an initial non-refundable 50% deposit is required to hold the client’s place in the design queue. The remaining 50% balance is due before the final comps are created and electronic files are delivered.
A La Carte Items, Packaged Projects or Promotional Packages
All other products must be paid in full before the project is added to the design queue.

Cancellation Policy
If the project is cancelled for any reason before the start date of your project, you may reschedule and you will be added to the bottom of the design queue. Cancellations made after the start of a project will lose their 50% deposit in full and can reschedule with another deposit. No exceptions will be made.

Refunds
Due to the digital nature of this business, there will be absolutely NO REFUNDS for any reason. No exceptions.

Revisions
Website Designs
The client is allowed up to 2 major rounds of revisions for premium webdesign services. If the client exceeds this amount, a fee of $75 per hour will occur and be included in the final invoice.

Logo Designs
The client is allowed up to 2 rounds of revisions. If the client exceeds this amount, a fee of $75 per hour will occur and be included in the final invoice.

Website/Graphic Design A La Carte Items
1 Small revision is allowed. If the client exceeds this amount, a fee of $75 per hour will occur and be invoiced.

Turnaround Time
HNIK strives to provide quality work in a timely manner. Upon acceptance of your design project, you will be given a turnaround time based on your individual project and the current listing in the design queue.

Rush Fees
We understand the needs of your growing business and we do allow rush projects for an additional fee. The additional fee is based on the time frame and size of the project. If you currently have a project in progress, we will try to move the start date up for an additional fee based on the size and time frame of the project.

Client Collateral
After your project has been accepted, a client checklist will be sent for you to provide any additional content needed to complete your project. Content must be received with 7 business days from the date of content request. If no content is received within 7 business days, from content request, your project will be placed at the end of the design queue. Collateral or communication not received within 15 business days of content request, your project will be considered abandoned. A new 50% deposit will be required to be re-added to the design queue, no exceptions.

Files
All files outlined in the specified contract will be released once full payment has been made. Only logo designs will be given the working EPS or AI files. Additional fee is required if all other projects are requesting the working PSD, AI, EPS files.

Payment
All packaged website, al a carte, or print related services less than $500, must be paid in full before your project begins.  All other projects require a non-refundable 50% deposit to hold your place in the design queue. The remaining 50% is due at the 75% completion mark of your project. Payments not made within 2 days after the completion mark, are subject to a late fee of 10% of the remaining fees. We accept credit cards, debit cards, and e-Check payments securely via Paypal. You do not need a paypal account to make a payment through Paypal. You will see a payment to “HNIK Design Boutique” on your bank statement. All deposits are non-refundable. No exceptions.

Payment Arrangements
We understand the budget constraints arise for every small business. We gladly offer payment arrangements for all premium and logo design packages for orders over $500. Payment terms will be discussed if your design project is accepted.

Hosting
Hosting is the responsibility of the client. Please contact me for a list of recommend hosting providers. HNIK Design Boutique does not offer hosting packages of any kind, and hosting is not included in web design projects. The client also understands that they must choose the approved hosting providers in order to have their design installed.

Communication
Email communication is HNIK Design Boutique’s primary method of contact via www.do.com. Email communication between the client and HINK is an electronic record of all change requests. This protects the client and HNIK, in the event miscommunication arises and keeps each project organized. Request to speak via phone must be scheduled in advance. Skype, iChat or Google Hangout are also available for communication.

Consultations
1 FREE 30 minute scheduled phone consultation is available Tuesday-Thursday from 6PM-7PM PST for all potential clients.

Office Hours
All phone calls are by appointment only and messages will be returned within 24-48 hours. Email correspondence is available 24 hours a day and most emails are returned within 1-2 business days. Any emails received after-working hours, will be returned the following business day. Monday-Friday 11AM-7PM PST, Saturday – by appointment only. We are closed on Sundays and all major holidays.

Technical Support
Each client purchasing a premium website related service will be given up to 10 days of Basic WordPress Support. A video or text/image based tutorial can be sent to help you navigate through WordPress. Please take the time after your website is installed to learn about the functionality of your WordPress Website. HNIK does not offer support for WordPress plugin related issues nor does HNIK guarantee plugin functionality. Most Plugins are created by 3rd party developers. If you have installed a plugin and it is not compatible with a newer version of WordPress after you have updated, please contact the author of the plugin. Technical support exceeding the allotted 4 days, may result in an additional hourly fee of $75 per hour. Clients altering the website coding, causing errors in the site design, will be charged an hourly rate of $75 an hour to fix. Do not alter the CSS coding or Website Files for any reason.

Site Security
You the client are responsible for backing up all the files and databases on your WordPress website. HNIK is not response for websites that have been hacked and/orfiles lost as a result of hacking or files being uploaded resulting in damage of your website. Please take the time to back up all of your files once the site has been installed.

Website Maintenance 

If you purchase a basic website maintenance package, it includes the following:

• Monthly Website Backup
• Update All Plugins
• Update Theme Files
• Run Security Checks
• Small Text Changes, Menu Changes, Link Updates, Image Changes
• No Design Changes Included

Not Included: Troubleshooting website, hacking, malware and theme related issues are an additional $50/hr not including actual cost to fix theme, hacking, malware, or plugin related issues. HNIK Is not responsible for theme updates, plugins, or hacking or malware that damages or breaks your website.

You the client understands:

Ownership
I understand that the final Website or Logo Design belongs to HNIK Design Boutique until I have paid HNIK Design Boutique in full. In the event of termination of this Agreement HNIK Design Boutique owns the Website and has the right to complete, exhibit, and/or sell the Website or Logo Design (but not my business name) if HNIK Design Boutique so chooses. HNIK Design Boutique also owns all the website and logo design concepts, created before I choose the final website or logo design.

Use of Website
I understand that once I have paid in full that I have the right to use the Website or Logo Design in all media useful for business promotion and that HNIK Design Boutique reserves the right to display the website for HNIK Design Boutique business promotional use (example of HNIK Design Boutique website designs on HNIK Design Boutique websites or printed on flyers).
I also give HNIK Design Boutique permission to use my full name,  and/or website address, for testimonial purposes on HNIK Design Boutique website, or other business related media.

Right to Modify (Alterations)
I understand that I have no right to alter the Final Website Design or Logo Design in anyway except to add news/updates or images as needed. You may not alter, copy, reproduce, trade or sell any designs for any commercial purpose without consent. I also reserve the right to display and link to your completed project on my site, portfolio or through social media. Altering the website design, layout, code, logos in any way violates the Intellectual Property Rights of HNIK Design Boutique.

Images
I will provide HNIK Design Boutique with any images needed for the creation of the website or graphic design related projects. I understand that I have full ownership of images or have written consent of the owner of images, photographs, logos, or artwork submitted for the use of my website. I understand that in the event stock images are needed, I will be charged and it will be invoiced into my final payment. I also understand that any photo editing or retouching is not included in the price. In the event images need to be editing for E-Commerce, Headers, or Bio images, an additional fee of $75 will be added to the final invoice. Please ensure photos are submitted in high quality format acceptable for print or web. Only logo designs will be given the working EPS or AI files. Additional fee is required if all other projects are requesting the working PSD, AI, EPS files.

Design Credit & Copyright
You the client will own the final graphic images and other visual elements that are created for your web, blog or logo design project. HNIK Design Boutique owns the design proofs, comps, sketches, files, CSS and other coding. Only logo designs will be given the working EPS or AI files. Additional fee is required if all other projects are requesting the working PSD, AI, EPS files.
 You may not alter, copy, reproduce, trade or sell any designs for any commercial purpose without consent. If transfer of ownership of all rights is desired, the rates may be increased. If the you client wishes the ownership of the rights to a specific design or concept, these may be purchased at any time for a recalculation of the hourly rate on the time billed or the entire project cost.

I reserve the right to display a “Designed by” line on applicable projects (i.e. flyers, posters, websites etc.). I also request a link back to http://hernameiskim.com to be displayed at the bottom of your website or blog for the duration of the use of the design. I also reserve the right to display and link to your completed project on my site, portfolio or through social media.

Copyrights and Trademarks
I understand that it is up to me to copyright the logo design (http://www.copyright.gov ) after final payment. It is also up to me to do a Trademark search and federal trademark registration if I want to register my logo as my company Trademark. Delays
I agree to give HNIK Design Boutique more time if HNIK Design Boutique becomes ill, is injured, or is delayed because of events beyond HNIK Design Boutique’s control, like: fire, theft, computer failure, software failure, death in family, relocation, and Acts of God (natural disasters) etc.

Confidentiality
All correspondence between you and HNIK Design Boutique is confidential and may not be shared or forwarded to others without expressed written consent.

Authorization
In order to install or make changes to your website, all clients agree to provide HNIK Design Boutique access to any hosting, domain account, or blog account for the sole purpose of installing and updating the web product as needed.

It is the client’s full responsibility to have read, understand and comply with HNIK Design Boutique prior to purchasing any services.

Shop

Due to the digital nature of the digital products in the shop, all purchases made in the shop are final, no exceptions. The copyright on all digital products (including without limitation the text, computer code, artwork, photographs, images, music, audio material, video material and audio-visual material on this website) is owned by Kimberly Marie Clements  and its licensors.

Copyright license

Kimberly Marie Clements  and HNIK Branding + Design Studio grants to you a worldwide non-exclusive royalty-free revocable license to:
